PrimusTech PH provides ICT and management consulting services to small and medium enterprises (SMEs), non-governmental organizations (NGOs), and local government units (LGUs) in the Philippines. Our services include, but are not limited to: website development, social media management, brand identity design, custom software development, cybersecurity consulting, data privacy compliance, business intelligence, infrastructure modernization, and training programs.

All service engagements are governed by a separate service agreement or contract executed between PrimusTech PH and the client. In the event of any conflict between these Terms of Service and a signed service agreement, the signed service agreement shall prevail.

We reserve the right to modify, suspend, or discontinue any service at any time. We shall not be liable to you or any third party for any modification, suspension, or discontinuation of services.

You agree to use our website and services only for lawful purposes and in a manner consistent with all applicable Philippine laws, including but not limited to Republic Act No. 10175 (Cybercrime Prevention Act of 2012) and Republic Act No. 10173 (Data Privacy Act of 2012).

You must not use our services to transmit, distribute, or store material that is unlawful, harmful, threatening, abusive, defamatory, obscene, or otherwise objectionable. You must not attempt to gain unauthorized access to any part of our systems, networks, or data.

You must not engage in any activity that disrupts or interferes with the proper functioning of our website or services, including the introduction of malicious code, denial-of-service attacks, or any other harmful technical actions.

All content on this website, including but not limited to text, graphics, logos, icons, images, audio clips, and software, is the property of Primus-Inter-Pares Tech Solutions, Inc. or its content suppliers and is protected under applicable Philippine and international intellectual property laws.

Any deliverables produced under a client engagement remain subject to the intellectual property provisions of the applicable service agreement. Unless otherwise agreed in writing, PrimusTech PH retains ownership of all proprietary tools, frameworks, and methodologies used in delivering services.

In the course of providing services, PrimusTech PH may have access to confidential information belonging to clients. We treat all client information with strict confidentiality and do not disclose it to third parties except as required by law or as expressly authorized by the client.

Clients who share proprietary business information, trade secrets, or sensitive operational data with PrimusTech PH for the purpose of service delivery acknowledge that such information will be used solely for that purpose.

Specific confidentiality obligations for individual engagements are detailed in the applicable non-disclosure agreement (NDA) or service contract.

PrimusTech PH is committed to compliance with Republic Act No. 10173 (Data Privacy Act of 2012) and its implementing rules and regulations. We collect, process, and store personal data only as necessary for the delivery of our services and in accordance with our Privacy Policy.

By using our website or engaging our services, you consent to the collection and processing of your personal data as described in our Privacy Policy. You have the right to access, correct, and request deletion of your personal data in accordance with applicable law.

We implement appropriate technical and organizational measures to protect personal data against unauthorized access, disclosure, alteration, or destruction.

To the fullest extent permitted by applicable law, PrimusTech PH shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our website or services, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising out of or relating to these terms or our services shall not exceed the total amount paid by you to PrimusTech PH in the three (3) months preceding the event giving rise to the claim.

These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of the Philippines, without regard to its conflict of law provisions.

Any dispute arising out of or in connection with these terms shall first be subject to good-faith negotiation between the parties. If the dispute cannot be resolved through negotiation within thirty (30) days, it shall be submitted to mediation or arbitration in accordance with Philippine law.

The courts of the Philippines shall have exclusive jurisdiction over any disputes that cannot be resolved through alternative dispute resolution mechanisms.
